　　乙方(受聘人)

　　根据国家有关法律法规，甲乙双方按照自愿、平等、协商一致的原则，签订本合同。

　　一、合同有效期：合同期限为 年，自 年 月 日起至 年 月 日止，合同期满聘用关系自然终止。聘用期间基本工资为元/月;另外享受岗位津贴，聘用期间第一年岗位津贴为 元/月，以后随年度增加岗位津贴。绩效工资按医院效益酌情发放。

　　二、合同期满前一个月，经双方协商同意，可以续订聘用合同。如任何一方不再续订聘用合同的，应在合同期满前一个月书面通知对方。

　　三、甲方聘用乙方在 岗位从事 工作。甲方有权根据工作需要以及乙方的专业知识、工作经验及能力等综合考虑安排和调整乙方的工作岗位。

　　四、甲方负责安排乙方的工作，并且为其提供必要的、安全的工作条件及个人工作用品。

　　五、乙方接受聘用后，不得在本医院以外的任何单位兼职或坐诊。如有发现，轻者处罚，重者单位有权将其辞退，其在外所产生的任何纠纷导致的后果由其本人负责。

　　六、乙方享受聘用单位规定的工资待遇和相关福利，按双方约定的薪酬待遇，甲方以人民币现金支付。乙方应严格遵守医院有关经营、人事、财务、薪酬等项工作的保密制度，如有违反，甲方有权解除此合同。

　　七、乙方在聘用期间，必须遵守甲方的一切规章制度及《员工手册》，应服从领导，团结合作，尽职尽责做好本职工作。如有违反规定的，甲方有权调整其工作岗位或予以辞退，为此乙方应表示无异议。

　　八、聘用期第月，甲方按国家规定为乙方交纳养老保险金和医疗保险金，聘用期间若乙方违反甲方规章制度被除名或乙方自行离职，要如数退还甲方为乙方交纳的养老保险金和医疗保险金。

　　九、有下列情形之一的，甲方可以解除聘用合同，但应提前10天以书面形式通知乙方(受聘人)

　　1、乙方患病或非工伤医疗期满后不能从事原工作，也不愿意从事甲方另行安排工作的。

　　2、乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的。

　　3、聘用合同订立时所依据的客观条件发生重大变化，致使已签订的聘用合同无法履行，经当事人协商不能就变更聘用合同达成协议的。

　　十、乙方有下列情形之一的，甲方可以解除聘用合同：

　　1、乙方不履行聘用合同，或违反工作纪律和规章制度的。

　　2、严重失职，营私舞弊，给甲方利益造成损失的。

　　3、违法乱纪，被依法追究刑事责任的。

　　十一、乙方在接到解聘通知后，及时办理有关手续，结清有关帐务，并将聘用期间掌握的甲方经营、财务、人事、印章、证照和相关物资全部移交甲方，不得扣留、损毁、灭失、转移、否则应承担相应的民事责任。

　　十二、乙方如辞聘应提前30天书面告知甲方，即辞即走者，当月工资和奖金不予支付。

　　十三、甲方未按合同约定支付工作报酬或者提供工作条件的，乙方有权要求解除聘用合同。但应提前30天以书面形式通知甲方。

　　十四、乙方因用人单位未按照聘用合同的约定支付工资报酬，而通知甲方解除聘用合同的，甲方应按合同的约定结算，在解除聘用合同的同时支付欠发的工资报酬。

　　十五、聘用合同签订后，双方必须全面履行合同规定的义务，任何一方不得随意变更合同。确需变更时，双方协商同意一致，并按原签订程序变更合同，双方未能达成协议的，原合同继续有效。

　　十六、因不可抗力因素，致使本合同无法履行时，本合同自行终止，双方互不追究责任。

　　十七、本合同一式两份，甲乙双方各持一份，经双方签字后生效。

　　根据国家《劳动法》的有关规定，经双方友好平等协商自愿签定并共同遵守本合同。

　　一、乙方自愿受聘于甲方筹备工作，乙方按甲方工作需要及领导安排认真做好本职工作。受聘期间甲方有权根据工作需要及乙方的工作能力和表现，调整乙方的工作，乙方必须服从安排。

　　七、本酒店的《员工手册》和各项管理制度，应视为本合同的组成条款，乙方必须认真学习，严格遵守，执行。甲方可根据实际情况依法进行修订，解释权属甲方所有。

　　八、乙方在受聘内应按《员工手册》中的劳动纪律，员工行为规范，奖罚制度，员工培训，安全生产，操作规程等要求，勤奋工作，尽职尽责，为酒店的建设与发展做出贡献，共创企业辉煌伟绩。如严重违反，按有关条例处罚。

　　九、违约：在合同期内，任何一方如不遵守本合同条款，均属违约，如乙方自动离岗，除扣发当月基本工资外违约方赔偿对方违约金(以本人月基本工资数额为罚金)。

　　十、本合同一式两份，双方各执一份，合同中未尽事宜，应经双方友好协商解决，如有争议也可通过当地劳动局仲裁部门依法解决。本合同自双方签字之日起生效。
